La datificazione e le prospettive giuslavoristiche dell’AI Act

Abstract

The development of Artificial Intelligence (AI) raises relevant issues from the point of view of labor regulation that require a forward looking approach capable of assessing risks and opportunities suitable for ensuring the protection of workers in new scenarios, in line with the guarantee perspective typical of labor law. After a general introduction on the topic of digitalization and the most recent European regulations, the contribution presents an overview of the current scenarios of datafication applied to the labor market. The provisions of the AI Act on algorithmic transparency and related worker protections are then analyzed. The conclusions underline the importance of anthropocentrism in AI and automated systems, through the involvement of workers and their representatives
in such transformation processes of companies affected by the growing use
of AI systems.
